Plain-English purpose These Terms form the contract for using Galware.shop and ordering from Galware. Nothing here removes a mandatory consumer right. Material purchase terms must be shown before payment and accepted through a conspicuous purchase flow. |
1. Agreement to these Terms
These Terms & Conditions ("Terms") govern Galware.shop and U.S. purchases from Galware. Your purchase agreement arises when you submit an order after receiving conspicuous notice of these Terms and the policies linked in the purchase flow and taking the affirmative action identified there. Site-use rules apply to the extent enforceable, but Galware does not rely on passive browsing alone to establish assent to material sales terms. If you do not agree, do not place an order.
You must be at least the age of majority where you live to create an account or place an order, or act with the involvement and permission of a parent or legal guardian who accepts these Terms. The seller is H2 Holdings, LLC dba Galware.
2. About Galware and the U.S.-only store
Galware is a small Nashville, Tennessee business that creates and sells apparel and other products. Many products are produced or decorated after an order is placed. The store is hosted by Shopify, and checkout, payments, fraud screening, and related services may be provided by Shopify and other providers.
The store accepts orders only for delivery within the 50 United States and the District of Columbia. It does not offer delivery to U.S. territories, APO/FPO/DPO addresses, freight forwarders used to export an order, or addresses outside the United States.
3. Accounts and accurate information
You are responsible for accurate order, contact, billing, shipping, size, color, and customization information. Protect account credentials and notify us promptly of suspected unauthorized use. We may suspend an account or order to investigate fraud, abuse, security risk, or a violation of these Terms.
4. Product information, photographs, and digital mockups
We work to describe products accurately, but most made-to-order listing images are digital mockups rather than photographs of the exact finished item. A mockup is a visual aid—not a guarantee of every pixel, shade, fold, texture, edge, scale, or lighting effect. A listing labeled as an actual-item photograph shows that piece, but lighting and screens still affect perceived color.
Screens, brightness, lighting, supplier images, materials, finishes and production lots can change how a product’s color and texture appear. For garments, fabric and dye lots can create additional variation.
A design can look somewhat softer, less luminous, less saturated or different in contrast after it is applied to a physical product than it looks on a backlit screen.
Pose, perspective, folds, product shape and mockup composition can make a design appear off-center or differently scaled in an image. Galware centers and sizes designs during production, subject to small normal application variation.
Small commercially reasonable variations in garment dimensions, texture, color, print placement, or application are inherent in apparel production and are not automatically defects.
These disclosures do not excuse a wrong item, wrong design, major placement or scale error, material color departure, defective application, damaged product, or other material nonconformity. Those issues are handled under the Return & Refund Policy and applicable law.
5. Garment size, fit, and care
For garments, product-page measurements control over general size labels. Compare the chart with a similar garment you own, measured flat in the same way. If Galware sends the size ordered, fit is not a return reason except where law requires otherwise. Care instructions are part of the product information. Damage caused by incorrect laundering, heat, chemicals, abrasion, alteration, or misuse is not a Galware defect.
6. Orders, acceptance, and availability
An order confirmation acknowledges receipt; it does not require Galware to accept an order. We may refuse or cancel an order before fulfillment for suspected fraud, a pricing or listing error, legal restrictions, inability to obtain materials, or another legitimate business reason. If we cancel a paid order, we will refund the affected amount.
Products, materials, colors and variants can become unavailable. Galware will not materially substitute a product, style, design, material, color or other selected option without your consent.
7. Prices, taxes, and payment
Prices are displayed in U.S. dollars and may change prospectively. The final checkout total shows product price, discounts, shipping, taxes collected by Galware, and other charges before payment. You authorize the selected payment provider to charge the final amount. We may correct a genuine pricing error before acceptance; if you already paid, you may cancel for a full refund rather than accept a corrected price.
8. Final sale, special colors, and proofs
Except where applicable law requires otherwise, all Galware products are final sale for change of mind, fit, gift rejection, subjective appearance, or customer selection/address errors. This includes made-to-order products, curated combinations, alternate colors, approved-proof/custom items, sale or limited-run products, and "Already Made/In Stock" items. The Return & Refund Policy states the complete voluntary eligibility list and preserves mandatory rights.
A special color or custom instruction may require a proof or written acknowledgment. Silence is not approval. The customer has two business days after Galware sends the approval request; Galware will send one reasonable reminder and may then cancel and refund the affected item if express approval is not received.
Approval accepts the visible design, text, color direction, placement concept, and instructions shown, subject to disclosed normal physical-production variation. It does not waive a remedy for a Galware error, material defect, or material departure from the approved proof.
9. Changes and cancellations
Send a requested order change to hello@galware.shop immediately, preferably within two hours. We will try to help but cannot guarantee a change after payment. Once production or a supplier commitment begins, an order cannot be changed or canceled except where the Return & Refund Policy or applicable law provides otherwise.
10. Production, shipping, delivery, and events beyond control
Galware ships only to destinations enabled at checkout within the 50 United States and the District of Columbia. An unsupported-destination order may be refused or canceled, and any captured payment will be refunded. Galware does not authorize use of a freight forwarder to export an order; any forwarding after accurate delivery is outside Galware's shipping service to the extent permitted by law.
Production and delivery estimates are not guarantees unless Galware expressly agrees in writing to a guaranteed date. Galware bears risk of loss or transit damage until the carrier records delivery to the confirmed address or a person you designate, subject to applicable law. Provide a complete, secure, deliverable address. Customer-caused address corrections, return-to-sender shipments, or reshipments may require payment of actual additional costs.
Galware is not responsible for delay caused by events beyond its reasonable control, such as severe weather, carrier disruptions, labor actions, supplier interruption, utility or platform outage, cyberattack, disaster, epidemic, or government action. This clause does not remove any notice, consent, cancellation, or prompt-refund right under the FTC Mail, Internet, or Telephone Order Merchandise Rule or other applicable law.
11. Returns, refunds, defects, and delivery claims
The Return & Refund Policy is part of these Terms and states Galware's exclusive voluntary U.S. return program. In short: if Galware gets the order materially wrong, an item has a qualifying defect, or a package is confirmed lost or misdelivered, Galware will review and make it right; if it arrives as ordered and within disclosed normal variation, it is final sale. Mandatory consumer, warranty, and nonconforming-goods rights remain available.
12. Promotions, gift cards, and discounts
A promotion may have separate rules that control if they conflict with these Terms. Discounts cannot be combined unless stated. We may correct abuse, technical errors, or unauthorized codes. Gift cards, if offered, are subject to applicable expiration, fee, unclaimed-property, and consumer-protection laws and any terms presented with the card.
13. Galware intellectual property
The site and its original text, graphics, photographs, mockups, artwork, designs, logos, compilation, and software are owned by Galware or licensed to us and are protected by intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable license to use the site for personal shopping. You may not copy, reproduce, scrape, sell, create derivative merchandise from, or commercially exploit protected Galware content without written permission.
References to third-party brands, works, styles, cultural material, or products do not state or imply sponsorship, endorsement, or affiliation unless Galware expressly says so.
14. Customer-provided content and customization
If Galware allows you to submit text, artwork, photographs, names, logos, or other material for customization ("Customer Content"), you retain your rights in it. You grant Galware a limited license to reproduce, adapt, display, and use Customer Content only as reasonably necessary to quote, proof, produce, deliver, support, and document your order, unless you separately permit marketing use.
You represent that you have the rights and permissions needed for Customer Content and that it does not infringe intellectual-property, publicity, privacy, or other rights; contain unlawful or harmful material; or mislead Galware. We may refuse content. You are responsible for a third-party claim caused by your unlawful Customer Content, but not for a loss caused by Galware's own unauthorized change, misuse, negligence, or violation of law.
15. Reviews and other public submissions
You may share an honest review. Nothing in these Terms restricts or penalizes an honest opinion about Galware, our products, or our service. We may moderate content that is unlawful, clearly false or misleading, harassing, obscene, contains private/confidential information, infringes rights, or is unrelated to the product or service—without favoring positive reviews over negative ones.
If you give Galware specific permission to reuse a review, photo, or social post in marketing, you grant a nonexclusive, worldwide, royalty-free license for that approved use. Galware does not claim ownership of your review. Any incentive or material relationship will be disclosed as required.
16. Intellectual-property complaints
If you believe content on Galware.shop infringes your copyright, trademark, or other rights, email hello@galware.shop with your contact information, identification of the protected work or right, the exact URL or product, the basis for the complaint, and a statement that the information is accurate. Galware may remove or restrict content while reviewing a good-faith complaint. This process does not represent that Galware has designated an agent under the Digital Millennium Copyright Act; Galware will separately register and publish a DMCA agent if it chooses to rely on the statutory safe harbor for qualifying user content.
17. Prohibited conduct
Use the site for fraud, unlawful activity, harassment, infringement, malware, interference, unauthorized access, scraping, or circumvention of security controls.
Submit fabricated, materially altered, or misleading claim evidence; abuse refunds, chargebacks, promotions, or accounts; or use unauthorized payment information.
Misrepresent affiliation with Galware or use Galware content to create counterfeit, confusing, or unauthorized products.
Collect information about other users or probe the site without authorization.
Galware may investigate, preserve relevant records, refuse service, cancel an order, or report unlawful conduct when reasonably necessary and permitted by law. A fraud review will not be used to deny a valid nonwaivable consumer right.
18. Third-party services and links
Shopify, payment methods, social platforms, carriers, and linked sites may be governed by their own terms and privacy notices. Galware is not responsible for an independent third party's service, content, or policy, but remains responsible for Galware's own legal obligations to you.
19. Privacy and electronic communications
Galware.shop is hosted by Shopify. When you visit or make a purchase from the store, Shopify collects and processes personal information to provide platform and commerce services, including services informed by your interactions with Galware, other Shopify merchants, and Shopify. Information about your activity may be shared with Shopify and relevant service providers or other third parties, including parties located in other countries, as explained in our Privacy Policy and Shopify’s Consumer Privacy Policy at https://privacy.shopify.com.
The Privacy Policy explains our personal-information practices. By providing electronic contact information, you consent to receive transaction, account, proof, security, and legal communications electronically. Marketing is optional and may be stopped using the provided unsubscribe or stop method. Electronic records and signatures may be used to the extent permitted by law; you may retain these Terms by printing or saving them.
20. Site availability and product warranties
The site and general informational content are provided on an "as available" basis. We do not promise uninterrupted or error-free access. We may maintain, change, or discontinue site features prospectively.
Products remain subject to the descriptions, express promises, and nonwaivable implied warranties and consumer remedies that apply to the sale. Galware does not disclaim a warranty or remedy that the law does not allow it to disclaim. Any voluntary Galware remedy is described in the Return & Refund Policy and does not replace statutory rights.
21. Limitation of liability
To the fullest extent permitted by law, Galware is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages that were not reasonably foreseeable from the transaction. For a claim arising from a product or order, Galware's aggregate contractual liability will not exceed the amount paid for the affected order, except where a greater remedy is required by law.
These limits do not apply to liability that cannot lawfully be limited, including fraud, willful misconduct, gross negligence where not limitable, personal injury caused by negligence where not limitable, or a mandatory consumer remedy. Some jurisdictions do not allow certain exclusions, so the limits apply only to the extent permitted where you live.
22. Governing law and disputes
Before filing a claim, please contact us and give both sides a reasonable opportunity to resolve it. These Terms and U.S. transactions are governed by Tennessee law, without regard to conflict-of-law rules, except that mandatory consumer law of your home jurisdiction remains available when it cannot be waived.
Subject to any mandatory right to bring a claim elsewhere, disputes will be brought in the state or federal courts located in Davidson County, Tennessee, and each party consents to personal jurisdiction there. These Terms do not require arbitration and do not waive participation in a class action.
23. General terms and contact
These Terms, the Return & Refund Policy, the Privacy Policy, the confirmed order, and any specific promotion or proof terms presented for the order form the agreement for that transaction. If a provision is unenforceable, it will be narrowed or severed only as necessary, and the rest remains in effect. Failure to enforce a provision is not a waiver. You may not transfer an order or these Terms without our consent; Galware may assign them as part of a business reorganization if customer rights are not materially reduced. Headings are for convenience.
We may update these Terms prospectively. The version presented with an order governs that order unless the parties agree otherwise or law requires a change. Material changes receive notice when required.
